Florida HOA fining committee: role and membership

The board levies the proposed fine. A separate committee holds the hearing and determines whether to confirm or reject it.

At least three members

The committee must have at least three members appointed by the board.

Who the published text excludes

Committee members may not be officers, directors, or employees of the association. The statute also excludes the spouse, parent, child, brother, or sister of an officer, director, or employee.

A limited role

The committee does not create the original fine. Its statutory role is limited to confirming or rejecting the fine or suspension levied by the board. If a majority does not approve it, the proposed fine or suspension may not be imposed.

After the hearing

The committee must send written findings within 7 days. If it confirms an uncured violation and fine, it sets a payment date at least 30 days after delivery of that written notice.
